1.2 These Promotion Terms apply to you when you place an order on our Website using one of the Promotions referred to in these Promotion Terms. By participating in a Promotion, you agree to these Promotion Terms.

1.3 Please read these Promotion Terms carefully before placing an order and keep a copy for future reference. If you don’t understand anything in these Promotion Terms, you can contact us for help by using the contact information set out in section 2 below.

1.4 We may change these Promotion Terms at any time and for any reason, including to reflect changes affecting our Website, our products and services, the Promotions that we are running from time to time, our technology, our licensing arrangements, our payment policies, best practices, relevant laws and/or regulatory requirements. When we do so, we will update the “Last Updated” date above. Before participating in a Promotion, you should check these Promotion Terms to make sure you are aware of any changes.

1.5 The following other terms and policies may also apply to you when you participate in a Promotion on our Website and we urge you to read these carefully to ensure you understand them:

3. General promotion terms

3.1 To participate in a Promotion, you must satisfy the following eligibility criteria: (i) you are a consumer (not a business); (ii) you are 18 years of age or older; (iii) you are a resident of the United Kingdom and we deliver to your delivery address (please see section 8 of our ); and (iv) you are able to make payment via one of our accepted payment methods (please see section 7 of our ). We reserve the right at any time to require proof of your eligibility.

3.2  You can only participate in a Promotion when making a purchase directly from us on our Website. Our Promotions are not valid on any third-party website or in any physical store.

3.3 Products available in the outlet on our Website are excluded from Promotions unless otherwise expressly stated in these Promotion Terms.

3.4 Promotions cannot be combined with any other promotional discount, coupon or offer we may be running at the same time unless otherwise expressly stated in the terms that apply to the relevant Promotion.

3.5 All products are strictly subject to availability. In particular some products included in a Promotion may be in high demand and may sell out before the end of the Promotion. Once stocks of these products have been exhausted, they may not be replenished.

3.6 All promotional discounts and savings apply only to the VAT-inclusive purchase price of qualifying products. Promotional discounts and savings do not apply to delivery charges or any other costs associated with your purchase.

3.7 If you return a product purchased during a Promotion, any refund due to you will be refunded at the discounted price actually paid by you.

3.8 We reserve the right to cancel, amend, withdraw, terminate or suspend a Promotion at any time and for any reason without notice.

4. Newsletter welcome discount

4.1 We offer a one-time 10% welcome discount to those who sign up to our email newsletter on our Website.

4.2 To receive the welcome discount, visit our Website and sign up to the Bodyform email newsletter using a valid email address. Once you have signed up, we will send you a confirmation email. You must then click the link in the email to confirm you have opted in to receive our email newsletter. Once you have completed this process, you will receive an automated email which includes the 10% welcome discount code.

4.3 You will only be eligible for the welcome discount the first time that you sign up to the email newsletter. If you later opt out of receiving the email newsletter and then sign up again, you will not receive another welcome discount. We reserve the right to reject any use of a welcome discount code if we have reason to believe that you have already used this Promotion in a previous order.

4.4 To use your welcome discount, simply enter the discount code during the checkout process when placing your order. The discount will then be applied automatically to the final basket value.

4.5 You must ensure that you use the discount code correctly when placing your order. The discount code cannot be applied to an order after the order has been submitted.

 4.6 You can use your welcome discount when purchasing products during a sale. If you do so, the welcome discount will be applied to the final basket value after all other discounts have been applied. For example, if you purchase products that are already subject to a 20% sale discount, the welcome discount will be applied to the discounted price of the products (i.e. after the 20% discount) and not to the original price of the products.

4.7 You can use your welcome discount on the purchase of products available in the outlet on our Website.

4.8 The welcome discount can be used on multibuy purchases, Bundle & Save and bundle purchases, subject to the terms applicable to those promotions (see relevant sections below). 

4.9 The welcome discount cannot be combined with the abandoned basket discount.

4.10 Only one discount code can be applied per transaction. Unless otherwise expressly stated, the welcome discount cannot be combined with any other promotional discount, coupon or offer we may be running at the same time, including multibuys.

4.11 The discount code can only be used by the original recipient of our Promotion email and can only be used once.

4.12  Discount codes are not transferable to another person, have no monetary value and cannot be redeemed or exchanged for cash or credit.

 5. Abandoned basket discount

5.1 From time to time, we may (in our discretion) offer a one-time discount to those who begin the checkout process on our Website but fail to complete their purchase. We have no obligation to offer you an abandoned basket discount to complete your purchase but, if we choose to do so, this will only happen if we have collected your email address during the checkout process and we have your consent or another lawful basis to send email marketing to you (please see our Privacy Notice for more information). 

5.2 If we send you an abandoned basket discount code by email, you will be entitled to use the discount code to obtain a discount on the products in your abandoned basket as an incentive to complete your purchase. The discount will be the percentage amount stated in the email we send you. 

5.3 You are only eligible to receive an abandoned basket discount once, regardless of whether you are using the same or a different email address. We reserve the right to reject any use of an abandoned basket discount code if we have reason to believe that you have already used this Promotion in a previous order. 

5.4 To use your discount, simply visit our Website, access your saved basket and enter the discount code during the checkout process when placing your order. The discount will then be applied automatically to the final basket value. 

5.5 Please be aware that we use cookies to remember what was in your basket and therefore if you clear or delete the cookies on your device, your saved basket will be lost and you will not be able to use your discount code 

5.6 You must ensure that you use the discount code correctly when placing your order. The discount code cannot be applied to an order after the order has been submitted. 

5.7 You can use your abandoned basket discount when purchasing products during a sale. If you do so, the abandoned basket discount will be applied to the final basket value after all other discounts have been applied.For example, if you purchase products that are already subject to a 20% sale discount, the abandoned basket discount will be applied to the discounted price of the products (i.e. after the 20% discount) and not to the original price of the products. 

 5.8 Products available in the outlet on our Website are excluded from this Promotion and will not benefit from the discount. 

5.9 The abandoned basket discount can be used on top of sitewide sale discounts. 

5.10 The abandoned basket discount cannot be combined with other discount codes, including the welcome discount. 

5.11 Only one discount code can be applied per transaction. Unless otherwise expressly stated, the abandoned basket discount cannot be combined with any other promotional discount, coupon or offer we may be running at the same time, including multibuys. 

5.12 The discount code can only be used by the original recipient of our Promotion email and can only be used once. 

5.13 Discount codes are not transferable to another person, have no monetary value and cannot be redeemed or exchanged for cash or credit. 

6. Affiliate discounts (new and returning customers)

6.1 From time to time, we may partner with influencers who may offer an affiliate discount code for our Website through their social media channels.

6.2 If you receive a valid affiliate discount code for our Website from a third-party website or an influencer you are following on social media, you will be entitled to use that discount code against the purchase of qualifying products on our Website, subject to the terms and conditions set out in this section.

6.3 The amount of the affiliate discount will vary from time to time, depending on the influencer and the campaign. It may be a fixed percentage discount on a specific qualifying product, or a fixed percentage discount across a range of qualifying products. In some cases a minimum order value may apply (e.g. 10% off orders of £35 or more). If a minimum order value applies, the discount will only apply where the final basket value for qualifying products (excluding delivery charges) reaches or exceeds the minimum order value.

6.4 To use your affiliate discount, simply enter the discount code during the checkout process when placing your order. The discount will then be applied automatically to the final basket value.

7. Multibuy promotions

7.1  We offer the following multibuy discounts on our Website:

(a) Purchase two full-priced or sale-priced qualifying products to receive 10% off; and

(b) Purchase three full-priced or sale-priced qualifying products to receive 20% off.

7.2 The discount will only apply to the qualifying multibuy products in your basket. If you are purchasing other products at the same time as the qualifying multibuy products, the other products in your basket will not benefit from the multibuy discount (although they may be eligible for other Promotions).  

7.3  Multipacks are excluded from this Promotion and will not benefit from the multibuy discount.

7.4 To receive the multibuy discount, simply place qualifying multibuy products in your basket and the multibuy discount will be applied automatically to the final basket value during the checkout process.

7.5 You can use a welcome discount or an abandoned basket discount (but not both together) when making a multibuy purchase. If you do so, the welcome discount or abandoned basket discount will be applied to the final basket value after the multibuy discount has been applied. For example, if you purchase three full-priced or sale-priced qualifying products to receive 20% off, the 20% discount will be applied first, then the welcome discount or abandoned basket discount will be applied to the discounted price of the products (i.e. after the 20% discount) and not to the original price of the products.

7.6 The multibuy discount applies to products available in the outlet on our Website.

7.7 The multibuy discount does not apply to sale-priced products.

7.8 Except in the case of welcome discount and the abandoned basket discount (see sections 4 and 5), the multibuy discount cannot be combined with any other promotional discount, coupon or offer we may be running at the same time.

7.9 Only one multibuy discount can be applied per transaction.

8. Promotions

 8.1 We offer a Bundle & Save offer on qualifying products on our Website.

8.2 If a product qualifies for Bundle & Save this will be indicated in the product listing by the inclusion of a “Bundle & Save” button next to the “Add to cart” button. When you select the “Bundle & Save” button, we will automatically propose one or more bundles of three or four qualifying products that, if purchased together, offer a combined saving against the individual selling prices of the qualifying products.  

8.3 You can use a welcome discount or an abandoned basket discount (but not both together) when making a Bundle & Save purchase. If you do so, the welcome discount or abandoned basket discount will be applied to the final basket value after the Bundle & Save has been applied and not to the original individual price of the products.

8.4 Bundle & Save can be applied to products available in the outlet on our Website if the relevant outlet product is identified as qualifying for Bundle & Save in the product listing.

8.5 Except in the case of the welcome discount and the abandoned basket discount (see sections 4 and 5), Bundle & Save cannot be combined with any other promotional discount, coupon or offer we may be running at the same time, including multibuys.

8.6 Products qualifying for Bundle & Save are subject to change without notice. From time to time, we may add new qualifying products and remove other qualifying products from Bundle & Save, although this won’t affect any orders you have already placed using this Promotion.

9. Bundles

9.1 Some products are available for purchase as part of a pre-selected bundle on our Website, offering a combined saving of up to 30% against the individual selling prices of the qualifying products.Products and discounts within bundles are are subject to change without notice.

9.2 To purchase a bundle, simply visit the “Bundles” page on our Website and select the size of the products that you require. When you add the bundle to your basket, the saving will be automatically calculated.  

9.3 You can use a welcome discount or an abandoned basket discount (but not both together) when purchasing a bundle. If you do so, the welcome discount or abandoned basket discount will be applied to the final basket value after the bundle saving has been applied and not to the original individual price of the products.

9.4  Except in the case of the welcome discount and the abandoned basket discount (see sections bundles cannot be combined with any other promotional discount, coupon or offer we may be running at the same time, including multibuys.

Bundle Giveaway Terms and Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by participating all entrants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

2. Promotion is open to residents of the United Kingdom (England, Scotland, Wales and Northern Ireland) aged 18 and over at the time of entry, excluding employees of Essity Ltd., and their immediate families, their agencies, or anyone else professionally connected with the Promotion. Failure to comply with any part of this clause will disqualify the respective entry from the promotion.
3. No purchase necessary. Internet access required and entrants must have an active and public Instagram account. If you do not have an account you will need to create one in order to participate – you will require an active email address in order to do this.
4. Entries will be subject to Instagram’s terms of use as relevant, which are available online at https://help.instagram.com/581066165581870.

6. To enter prize draw entrants must:
   Like the promotional post dated 5^th December 2024 and comment with your staycation must-haves on Instagram (https://www.instagram.com/bodyformuk/) and follow the BodyformUK Instagram page during the promotional period.
7. One entry per person on the above Instagram post will be accepted, regardless of the number of comments made. For the avoidance of doubt, a participant can use one Instagram account to enter and can enter the prize promotion on Instagram only. Anyone trying to circumvent this rule by using alternative details including but not limited to creating multiple Instagram accounts will be disqualified from this promotion. Entries (bulk or otherwise) made from trade, syndicates, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this or any other condition, by example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified any prize award will be void.
8. The entrant entering the promotion must be the owner of the Instagram account used. Proof of ownership of the social media account and proof of age may be required.
9. Any entries received from private accounts on Instagram will not be entered due to privacy restrictions. To enter from a private account, participants must amend their account settings to a public account in order for their entry to be accepted.10. Participants must continue to keep their Instagram account on a public setting for 4 weeks after the end of the promotional period in order to be contacted if they are selected as the winner.
10. The promoter monitors responses to this promotion and if any responses or any previous posts made by an entrant are or could be regarded as being disrespectful towards other members of the Instagram community or which contain anything which is likely to or could cause offence or distress will be disqualified from the promotion. Entrants are solely responsible for the information they provide and views they express on their Instagram account.
11. Entries will be deemed invalid if any post:

- Contains defamatory, malicious, indecent, obscene or other inappropriate content;

- In the reasonable opinion of the Promoter, cause any widespread or serious offence (taking into account prevailing community views or standards);

- Contains any content that is offensive or could reflect negatively on the name, reputation, or goodwill of the Promoter or any brand partner;

- Defames, misrepresents, or contains content for the intended purpose of harassing, threatening or embarrassing individuals or multiple individuals or insults other people or companies, including, but not limited to the Promoter (including its partners);

- Promotes any political, blasphemous or religious agenda or any content deemed to incite religious or racial hatred;

- Contains images of third parties who have not expressly consented to feature in promotion;

- Contains any images of children;

- Contains any form of inaccurate tagging;

- Includes trademarks, logos, or copyrighted material not owned by the entrant or used without the right holder’s prior written permission (including famous names, company names, etc.);

- Includes the name or image of any individual without their express permission;

- Contains content deemed socially irresponsible or likely to breach the CAP Code;

- Any Instagram name or profile photograph which contravenes the above will be void, and any entries will not count.

13. The Promoter and their agents reserve the right to reject any entries which contravene these terms and conditions. Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.
14. The Promoter will not be liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries, which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid due to technical reasons or otherwise.
15. There is a total of 1 winner, who will receive a staycation essentials bag, including the new period pant and pad bundle, consisting of:

16. The prize is non-negotiable, non-transferable and non-refundable. No cash alternative is available in whole or in part. In the event of circumstances outside of its control, the Promoter reserves the right to substitute the prize or part of the prize for a prize of equal or higher value.
17. The winner will be chosen at random via an independently verified, randomised computer process from all valid entries on 10^nd December 2024.
18. Proof of ID (full name and age) will be required as part of the verification process. The winner will be the first entry randomly drawn which meets the entry criteria.
19. The winner will be notified of their selection via private message to the Instagram account used to enter within two working days of the prize draw and asked to respond via direct message for verification and claim details – including sizing of period pants and pyjamas, delivery address and proof of ID including date of birth (passport, driving licence or equivalent form of identification that clearly states the winner’s date of birth). County of residence will be requested for the purpose of the winners list if no objection is received. If the winner cannot be contacted or does not confirm acceptance of their prize within fourteen days of initial notification, despite multiple contact attempts, or is ineligible the Promoter reserves the right to withdraw the prize from the original winner who will have their prize forfeited and pick a replacement winner drawn at the same time as the original. 20. For the surname and county of residence of the winner send an email to essity@tangerinecomms.com with “Bodyform Staycation Essentials Giveaway – December 2024” within 3 months of the promotion closing date. The Promoter reserves the right to refuse such requests. Participants may request their surname and county are not published or be limited in scope in the event they win by emailing essity@tangerinecomms.com before the promotion closing date. However, the Promoter shall provide the surname and county of the winner to the Advertising Standards Authority should this be requested.
21. It is the responsibility of the winner to provide their correct, up-to-date details at the time of acceptance in order for their prize to be processed. The Promoter and the Administrator cannot be held responsible for the winner failing to supply accurate information which affects prize acceptance or delivery.
22. The Promoter reserves the right to verify all entries including but not limited to asking for proof of ID including date of birth (passport, driving licence or equivalent form of identification that clearly states the winner’s date of birth). The Promoter reserves the right to refuse to award the prize or withdraw prize entitlement and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
23. In the event of unforeseen circumstances beyond the Promoter’s reasonable control, including by reason of infection by computer virus, network failure, traffic congestion, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right to cancel, modify or suspend the promotion or these terms and conditions, either in whole or in part, or invalidate any affected entries with or without notice. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions (including but not limited to global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God), the Promoter will not be liable for any failure to perform or delay in performing its obligations but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
24. The Promoter’s decision is final. No correspondence will be entered into.
25. Numerous factors outside the control of the Promoter may interfere with the operation of Instagram. The Promoter does not therefore guarantee continuous, uninterrupted or secure access to the website. The Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. You are providing your information to Essity Ltd. not to Instagram. By entering the promotion, all participants accept that they have no claim against Instagram. By entering the promotion, all participants agree to a complete liability release for Instagram.
26. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.
27. Any person posting, or seen to be posting, comments to the Promoter’s Instagram page or elsewhere during the Promotion that are considered bullying, spiteful or upsetting to other participants, associates or directly aimed at the Promoter, will have their comments removed and will be disqualified from the Promotion. The Promoter reserves the right to alert Instagram to any such behaviour, which may result in the person’s account being frozen pending investigation.
28. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded or limited by law (including personal injury, death and fraud).
29. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
30. These Terms and Conditions shall be governed by the law of the relevant country for each entrant, and entrants submit to the exclusive jurisdiction of the courts of the relevant country they reside in.
31. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose unless we have your consent. Your personal details will at all times be kept confidential and in accordance with applicable data protection legislation. 32. Under Article 17 of the GDPR individuals have the right to have personal data erased/to be forgotten. Any individual who is no longer happy for their personal information, entry or content to be processed for the purpose stated in section 26, entry or content or would like any inaccuracies rectified, can request this by sending an email to essity@tangerinecomms.com or can remove their own Instagram comment. Data will be stored for three months after the close of the promotion before deletion. By participating in the Promotion, you agree to the use of your personal data as described here.

For the avoidance of doubt, a participant can use one Facebook or Instagram account to enter and can enter the prize promotion on Facebook or Instagram only. Anyone trying to circumvent this rule by using alternative details including but not limited to creating multiple Facebook or Instagram accounts will be disqualified from this promotion. Entries (bulk or otherwise) made from trade, syndicates, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this or any other condition, by example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified any prize award will be void.
8. The entrant entering the promotion must be the owner of the Facebook or Instagram account used. Proof of ownership of the social media account and proof of age may be required.
9. Any entries received from private accounts on Facebook or Instagram will not be entered due to privacy restrictions. To enter from a private account, participants must amend their account settings to a public account in order for their entry to be accepted.
10. Participants must continue to keep their Facebook or Instagram account on a public setting for 4 weeks after the end of the promotional period in order to be contacted if they are selected as the winner.
11. The promoter monitors responses to this promotion and if any responses or any previous posts made by an entrant are or could be regarded as being disrespectful towards other members of the Facebook or Instagram community or which contain anything which is likely to or could cause offence or distress will be disqualified from the promotion. Entrants are solely responsible for the information they provide and views they express on their Facebook or Instagram account.
12. Entries will be deemed invalid if any post:

- Contains defamatory, malicious, indecent, obscene or other inappropriate content;

- In the reasonable opinion of the Promoter, cause any widespread or serious offence (taking into account prevailing community views or standards);

- Contains any content that is offensive or could reflect negatively on the name, reputation, or goodwill of the Promoter or any brand partner;

- Defames, misrepresents, or contains content for the intended purpose of harassing, threatening or embarrassing individuals or multiple individuals or insults other people or companies, including, but not limited to the Promoter (including its partners);

- Promotes any political, blasphemous or religious agenda or any content deemed to incite religious or racial hatred;

- Contains images of third parties who have not expressly consented to feature in promotion;

- Contains any images of children;

- Contains any form of tagging;

- Includes trademarks, logos, or copyrighted material not owned by the entrant or used without the right holder’s prior written permission (including famous names, company names, etc.);

- Includes the name or image of any individual without their express permission;

- Contains content deemed socially irresponsible or likely to breach the CAP Code;

- Any Facebook or Instagram name or profile photograph which contravenes the above will be void, and any entries will not count.

13. The Promoter and their agents reserve the right to reject any entries which contravene these terms and conditions. Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.
14. Incomplete, illegible, invalid or misdirected entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter will not be liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries, which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid due to technical reasons or otherwise.

16. The prize is non-negotiable, non-transferable and non-refundable. No cash alternative is available in whole or in part. In the event of circumstances outside of its control, the Promoter reserves the right to substitute the prize or part of the prize for a prize of equal or higher value.
    
17. The winner will be chosen at random via an independently verified, randomised computer process from all valid entries received during the promotional period on 2^nd January 2025.
18. Proof of ID (full name and age) will be required as part of the verification process. The winner will be the first entry randomly drawn which meets the entry criteria.
19. The winner will be notified of their win via direct message to the Facebook or Instagram account used to enter within two working days of the prize draw and asked to respond via direct message for verification and claim details within fourteen days – including sizing of period pants delivery address and proof of ID including date of birth (passport, driving licence or equivalent form of identification that clearly states the winner’s date of birth). County of residence will be requested for the purpose of the winners list if no objection is received. If the winner cannot be contacted or does not confirm acceptance of their prize within fourteen days of initial notification, despite multiple contact attempts, or is ineligible the Promoter reserves the right to withdraw the prize from the original winner who will have their prize forfeited and pick a replacement winner drawn at the same time as the original using the same method. This process will repeat for 3 months after which the prize will be null and void. Entrants are encouraged to monitor their Facebook or Instagram account during this time in case they are the winner.
20. For the surname and county of residence of the winner send an email to essity@tangerinecomms.com with the subject “Bodyform Christmas Giveaway – December 2024” within 3 months of the promotion closing date. The Promoter reserves the right to refuse such requests. Participants may request their surname and county are not published or be limited in scope in the event they win by emailing essity@tangerinecomms.com before the promotion closing date. However, the Promoter shall provide the surname and county of the winner to the Advertising Standards Authority should this be requested.
21. It is the responsibility of the winner to provide their correct, up-to-date details at the time of acceptance in order for their prize to be processed. The Promoter and the Administrator cannot be held responsible for the winner failing to supply accurate information which affects prize acceptance or delivery.
22. The Promoter reserves the right to verify all entries including but not limited to asking for proof of ID including date of birth (passport, driving licence or equivalent form of identification that clearly states the winner’s date of birth). The Promoter reserves the right to refuse to award the prize or withdraw prize entitlement and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.

In the event of unforeseen circumstances beyond the Promoter’s reasonable control, including by reason of infection by computer virus, network failure, traffic congestion, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right to cancel, modify or suspend the promotion or these terms and conditions, either in whole or in part, or invalidate any affected entries with or without notice. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions (including but not limited to global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God), the Promoter will not be liable for any failure to perform or delay in performing its obligations but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.

The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.
27. Any person posting, or seen to be posting, comments to the Promoter’s Facebook or Instagram page or elsewhere during the Promotion that are considered bullying, spiteful or upsetting to other participants, associates or directly aimed at the Promoter, will have their comments removed and will be disqualified from the Promotion. The Promoter reserves the right to alert Facebook or Instagram to any such behaviour, which may result in the person’s account being frozen pending investigation.
28. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded or limited by law (including personal injury, death and fraud).
29. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
30. These Terms and Conditions shall be governed by the law of the relevant country for each entrant, and entrants submit to the exclusive jurisdiction of the courts of the relevant country they reside in.

32. Under Article 17 of the GDPR individuals have the right to have personal data erased/to be forgotten. Data will be stored for three months after the close of the promotion before deletion. By participating in the Promotion, you agree to the use of your personal data as described here.
